1 Acceptance of Terms

By accessing and using Usafiri's platform and services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy.

If you do not agree with any part of these terms, you must not use our services.

2 Nature of Service

Usafiri operates solely as a technology platform that connects clients with independent drivers. We do not provide transportation services directly.

3 Limitation of Liability

Usafiri is NOT liable for any damages, losses, injuries, or incidents that occur during or as a result of transportation services arranged through our platform.

3.1 No Liability for Transportation Services

Since Usafiri only connects clients with independent drivers, we are not responsible for:

  • • Driver conduct, behavior, or actions
  • • Vehicle condition or maintenance
  • • Accidents, injuries, or property damage
  • • Route selection or driving decisions
  • • Loss, theft, or damage to personal property
  • • Delays, cancellations, or no-shows
  • • Any disputes between clients and drivers

3.2 Independent Contractor Relationship

All drivers on the Usafiri platform are independent contractors, not employees or agents of Usafiri. They operate their own businesses and make their own decisions regarding transportation services.

3.3 Use at Your Own Risk

By using our platform, you acknowledge and agree that you use transportation services arranged through Usafiri at your own risk. You agree to hold Usafiri harmless from any claims, damages, or losses arising from such services.

3.4 Maximum Liability

To the maximum extent permitted by law, Usafiri's total liability for any claims arising from the use of our platform shall not exceed the amount of fees paid by you to Usafiri in the 30 days preceding the incident.

4 User Responsibilities

As a user of Usafiri, you agree to:

5 Driver Verification

Please Note: These verification steps do not guarantee the performance, conduct, or safety of any driver. Usafiri makes no warranties or representations regarding driver qualifications beyond the verification performed.

6 Payments and Fees

6.1 Platform Fees: Usafiri charges service fees for facilitating connections between clients and drivers. All fees are clearly displayed before booking.

6.2 Payment Processing: Payments are processed securely through our platform. You agree to provide valid payment information.

6.3 Refund Policy: Refunds are handled on a case-by-case basis. Please contact support for refund requests.

6.4 Cancellation: Cancellation policies and any applicable fees will be clearly communicated at the time of booking.

7 Data Privacy

Your privacy is important to us. We collect, use, and protect your personal information in accordance with applicable data protection laws.

We collect: Name, contact information, payment details, location data, and usage information

We use your data to: Facilitate connections, process payments, improve services, and communicate with you

We protect: Your data using industry-standard security measures

8 Safety Guidelines

While Usafiri is not responsible for the conduct of drivers, we encourage all users to:

9 Prohibited Uses

You may not use the Usafiri platform to:

  • block Engage in illegal activities
  • block Harass, abuse, or harm others
  • block Impersonate others or provide false information
  • block Attempt to manipulate ratings or reviews
  • block Access the platform through unauthorized means

10 Account Termination

Usafiri reserves the right to suspend or terminate your account at any time, without prior notice, for violations of these Terms and Conditions, including but not limited to fraudulent activity, abuse of the platform, or any conduct that poses a risk to other users.

11 Dispute Resolution

Any disputes arising from these Terms or your use of the platform shall be resolved through:

  1. Good faith negotiation between the parties
  2. Mediation, if negotiation fails
  3. Arbitration under the laws of Kenya, if mediation is unsuccessful

12 Changes to Terms

Usafiri reserves the right to modify these Terms and Conditions at any time. We will notify users of significant changes via email or platform notification. Your continued use of the platform after changes constitutes acceptance of the modified terms.

13 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Kenya. Any legal action or proceeding relating to your use of the Usafiri platform shall be brought exclusively in the courts of Kenya.
